General terms and conditions
These General Terms and Conditions ("GTC") apply to participation in events as well as the sale of products and services by Amelie Group AG. By registering for an event, purchasing a ticket, or ordering products, the customer accepts these GTC.
Events
Registration, Payment, and Cancellation
- Registration for an event or purchase of a ticket is binding via the specified registration channels. The participation fee must be paid immediately after registration or within the specified payment period. The right to participate is granted only upon receipt of payment.
- Cancellation: Ticket purchases can be canceled up to and including 7 calendar days before the event with a full refund. After this period, refunds are excluded.
- Ticket Transfer: A ticket can be transferred to another person up to 48 hours before the event, subject to prior agreement with the organizer.
Organizer’s Regulations, Validity, and Changes to the Event
- The organizer’s regulations (safety requirements, age and other entry restrictions, etc.) must be followed. Any misuse of tickets is prohibited. The ticket buyer must ensure that the ticket is protected from misuse (e.g., unlawful copying, altering, or printing by unauthorized persons). The QR code and/or barcode must be machine-readable.
- No Right to Return or Exchange: Returning or exchanging tickets is generally excluded.
- Postponements: If events are postponed, tickets remain valid for the new event date.
- Cancellation by the Organizer: If an event is canceled by the organizer, the participation fee will be fully refunded. Alternatively, the ticket buyer may rebook for an equivalent event. Further claims, especially for damages, are excluded.
Sale of Products
Business Terms & Pricing
- Professional and Export Customers: Prices are exclusive of VAT.
- Private Customers: Prices are inclusive of VAT.
- Minimum Order Value:
- Export Customers: 3,000 CHF
- Professional Customers: 1,000 CHF (Orders below this amount: 50 CHF surcharge)
- Private Customers: 500 CHF (Orders below this amount: Shipping costs apply)
Availability & Order Acceptance
- Orders are subject to availability.
- The seller reserves the right to impose quantity limits or refuse orders.
Payment & Reminder Procedure
- Payment Terms: Vary depending on customer type and order history.
- Reminder Procedure in Case of Payment Default:
- First Reminder: No fee, 7-day payment period.
- Second Reminder: 20 CHF reminder fee, payable within 7 days.
- Third Reminder: 60 CHF reminder fee, payable within 10 days.
Returns & Liability
- Handmade Products may have slight variations.
- Right of Return: You have the right to return your purchase within 14 days of receiving the goods, provided the return is due to a change of mind and not because of a defect or error on our part.
- Please note: This return policy does not apply to wines. Wines are subject to a separate return policy, which is outlined independently and should be reviewed before purchasing wine products.
- Conditions for Returns:
- Items must be returned in their original condition, unused, and in their original packaging.
- Proof of purchase is required.
- Refunds and Deductions: Once the returned item has been received and inspected, a refund will be issued using the original payment method. Please note that the following costs will be deducted from the refund amount:
- Delivery costs, if delivery was not paid for separately by the client at the time of purchase.
- Payment processing fees, where applicable. If the order was paid online by card, a fee of 2.7% of the total amount paid will be deducted to cover transaction costs.
- Only the net amount after these deductions will be refunded.
- Return Shipping: The cost of returning the goods is the responsibility of the customer, unless the return is due to an error or defective product.
Data Protection & Account Security
- Protection of personal data within the scope of order and ticket management.
- No resale of personal data without explicit consent.
- Security: Online accounts are subject to strict data protection requirements.
Disclaimer of Liability
- Participation in events is at the participant's own risk.
- No liability for damages unless caused by gross negligence or intent by the organizer.
- IT Systems: No liability for disruptions, interruptions, or overloads.
- Unlawful System Interference: Liability is excluded unless gross negligence or intent is proven.
Intellectual Property
- All content, trademarks, and intellectual property rights exclusively belong to Amelie Group AG.
Jurisdiction & Applicable Law
- Austria law applies.
- The place of jurisdiction is Schwyz.
Changes to the GTC
- Changes to these GTC may be made at any time.
- Customers are encouraged to check the current version regularly.
